All bookings are subject to the Terms of Business below regardless of whether your reservation is made via phone call or via one of our company websites.

OUR RESPONSIBILITY TO YOU FOR YOUR BOOKING
As we are acting only as a booking agent we have no liability for any of the travel arrangements and in particular any liability for any illness, personal injury, death or loss of any kind.

Luxury Faraway Holidays a part of Superior Travel act as a Travel Agent only for the various components of your travel arrangements. By making a reservation with Luxury Faraway Holidays a part of Superior Travel you accept that your contract lies with the various travel providers (Principals) used to make up your reservation and you are therefore bound by their booking conditions. When making a booking with a No Frills Airline you are the principal of the booking and you are authorising us to act as your Agent.  A copy of the individual booking conditions that govern your reservation can be obtained by contacting our Customer Relations Department on 0845 370 5595.
When making your booking we will arrange for you to enter into a contract with the provider of the travel related service including, amongst others, tour operators, airlines, cruise companies and accommodation providers who may in some instances act as agents for the principal (the hotel directly). As an agent we accept no responsibility for the acts or omissions of the said travel providers. None of the bookings we make for our customers that comprise of more than one element are classed as package holidays as defined by the Package Travel Regulations 1992 and the Civil Aviation Regulations 1995, Amended 2003. As we are acting only as a booking agent we have no liability for any of the travel arrangements and in particular any liability for any illness, personal injury, death or loss of any kind.

PROTECTING YOUR MONEY
We are a member of the Association of British Travel Agents (ABTA). Our ABTA Number is L6489. More information about ABTA can be found on their website at www.abta.com. We are also accredited by IATA. All charter flights are licensed and bonded by the Civil Aviation Authority (CAA). We act as agents for licensed tour operators, in which case the relevant ATOL number is displayed with each flight shown. For your added protection we also hold an ATOL license ourselves, ATOL number 5360, and this protection extends primarily to customers who book and pay in the United Kingdom. In the unlikely event of our insolvency the CAA will ensure that you are not stranded abroad and will arrange to refund any money that you have paid to us for an advance booking.  ATOL protection is NOT in place for No Frills Airlines and these flights are not covered by the CAA. PASSPORT AND VISA AND HEALTH INFO/REQUIREMENTS

It is the responsibility of the lead passenger travelling to make sure that they hold the correct passport and visa requirements. Luxury Faraway Holidays a part of Superior Travel will not be held responsible for any financial costs that may be incurred as a direct result of failure to do so.
The information in this section is valid for British Citizens only. Non-British Citizens (including: citizens of British Dependent Territories; those who hold their citizenship by virtue of a connection with Gibraltar; British subjects who have a right of abode in the United Kingdom; and EC and other nationals) should consult the Embassy of their destination country and the Home Office Immigration Department regarding any special documentation for the countries they are visiting or for return to the UK. It is your responsibility to check with the applicable Embassy or Consulate to see whether the destination(s) that you are visiting requires a visa, especially if you do not hold a passport marked "British Citizen". If you fail to do so, you will be solely responsible for any cost, loss or damage which you or we incur as a result of your failure.
t is also important to remember to include all transit points of your journey, which may also require you to obtain a visa. Please note that many countries require that your passport is valid for six months beyond the period of your stay. Some countries apply different rules and you should contact the Embassy or Consulate of your destination for relevant current information. It is vital that you ensure that your passport is legible and intact, any sign of damage could result in a refusal of carriage or entry into your country of destination. If you hold a UK passport and require information in respect of the validity of your passport, procedure and time required to apply for a passport or renew an existing passport, the regulations in respect of minors, or if your passport has been lost or stolen, you can contact the UK Passport Service help line on 0870 521 0410 or on the internet at www.ukpa.gov.uk
It is your responsibility to obtain the appropriate visa for your destination(s) and any applicable transit point. If you require information in respect of current visa requirements, procedure and time required to apply for the applicable visa, you should contact the Foreign and Commonwealth Office. Their telephone number is 020 7008 8438 and their website address is www.fco.gov.uk. Please note that specific requirements for specific countries can be complex and subject to change at short notice.
Children not already included on a valid British passport will need to hold their own passport if they are to travel abroad The child reaches the age of 16; or

    * • The passport on which the child is included expires; or
    * • The passport on which the child is included is replaced or an amendment results in the issue of a new passport

The name on the passport must match the name on the ticket, otherwise you may not be able to travel and insurance may be invalid. If, after booking a holiday but before travelling, any member of your party changes their name, e.g. as a result of getting married, we must be notified immediately so that we can endeavour to make the necessary changes to your holiday documentation.
It is important that all travellers to the United States take note of the following:
A visa will be necessary for entry to the United States of America (USA) unless passengers are eligible under the Visa Waiver Program (VWP). The VWP allows holders of full British Citizens Passports who have the right of abode in the UK to complete a Visa Waiver Form and submit this on arrival. You must ensure that you comply with all USA Government requirements as per the Visa Waiver Form before confirming your booking.
All British passport holders, including children, travelling to the USA under the VWP will need their own machine-readable passports (MRP). This means that anyone without a MRP, including children who are currently on a parent's passport, will need a visa to travel to the USA. A British Passport is machine-readable when the white strip at the foot of the personal data page (at the back of the passport) bears two lines of print. If there is no white strip, or the white strip is blank, then the passport is not machine-readable.
If you have a serious communicable disease of public health significance including HIV you are not eligible to travel on the Visa Waiver Program, and must possess a valid visa for entry into the United States.
If you have ever been arrested or convicted for any reason in any country, even if the arrest did not lead to a conviction including driving offences, you may require a visa and should consult the US Embassy directly (details are below).

You should seek advice on any vaccinations and precautions that may be compulsory or recommended from a health professional – a GP, practice nurse, pharmacist or travel health clinic – ideally at least 8 weeks before you travel. Further travel advice can be found on www.fitfortravel.scot.nhs.uk and www.nathnac.org. Information about how to get medical treatment abroad and how to get reduced cost, and sometimes free treatment in Europe can be found in the NHS leaflet “Health Advice for Travellers”.

GENERAL BOOKING CONDITIONS

Lead Passenger
The person to whom the invoice is addressed is the Lead Passenger and henceforth the contract exists between the Lead Passenger and the said Travel Providers listed. The Lead Passenger accepts full responsibility for the booking including financial responsibility for all party members. All correspondence will take place between Luxury Faraway Holidays a part of Superior Travel and the Lead Passenger who is responsible for ensuring that all relevant documentation is received and checked prior to travel as we must be informed immediately of any errors or omissions therein. We do not accept any responsibility for any subsequent inconvenience or costs incurred if the client travels without the correct paperwork. The lead passenger must also inform all passengers of any changes that may have occurred since the booking was confirmed together with any visa and passport requirements appertaining to the reservation. They must also check that all party members are covered by an appropriate travel insurance policy.

Deposit Scheme/Schedule Flight Deposits
This scheme is based on accepting a booking on a lower deposit than is actually required in order to secure your booking. The agreed amount will be taken from your card at the time of booking with the balance being taken on an agreed date later. The exact date of which would have been clearly specified to you at the time of booking. In the event that you cancel your booking you will be held liable for the difference in the cancellation charge imposed by the Travel Provider and the low deposit amount already paid.
When paying a deposit only on a schedule flight the total flight price may not be confirmed until full balance is received as the deposit simply secures a confirmed allocation on the aircraft but does not guarantee the flight price.

Changing or Cancelling your Booking
In accordance with the Data Protection Act we are only permitted to speak to the Lead Passenger on the booking.  If the requested change is permitted you will be asked to confirm any amendment or cancellation in writing noting that any information and costs given are only valid at the time of the new quotation. It is therefore in your interest that we receive any written notification as soon as possible. If any changes have occurred in the interim we will inform you of the new details before proceeding. If you wish to cancel your booking the amount charged will depend on the charges imposed by the Travel Provider with whom your contract is with. Please note that all Scheduled Airlines and No Frills Flights are non-refundable and any cancellations will result in 100% loss.
For any amendment or cancellation, Luxury Faraway Holidays a part of Superior Travel are permitted to make an additional charge of £25.00 per person over and above that of the Travel Provider’s cost. We also make an additional charge of £5.00 per person over and above the Travel Provider’s cost if you choose to add an extra service related to your flights for example; pre-booked meals, baggage, seats or an upgrade etc. This cost covers our administration.

Accommodation Changes
From time to time the Travel Provider may no longer be able to provide the accommodation originally booked and so reserves the right to substitute it to an alternative of the same standard of which facilities may differ. Any change made will be in accordance of the booking conditions of the said provider. If we are informed of major building work that is being carried out at the hotel you will be given the option to change hotels or cancel your accommodation booking. We will endeavour to inform you as soon as possible if we are informed of any change to your booked accommodation and if there is time to do so before your departure. The Travel Provider does however reserve the right to move you on arrival at the airport/hotel.

Terms regarding Changes/Cancellation
All Flight and Accommodation bookings are made as separate components and as such any change that is actioned may affect the other component, but as each section is governed by that provider’s terms and conditions no responsibility is held for any subsequent inconvenience or costs incurred to the other components as a result of the said change.  For example, a travel provider may make a major change or cancel your accommodation, for which you are entitled to a full refund, but this will not apply to the flight component that you have booked as the provider’s standard booking conditions of this element will still apply. In addition, no responsibility is taken for any effect the change or cancellation may have on any independent travel arrangements that you may have made.

Descriptions & Photographs
All pictures and descriptions are displayed in good faith. However in certain circumstances beyond our control accommodation descriptions may be affected, such as sea views, which may be obscured by greenery, such as trees. We try to maintain up to date information on any changes and therefore all details printed should be regarded for general information only. Accommodation categories and star ratings shown on the website are provided by the accommodation, however standards can vary between accommodations of the same class in different countries, it is therefore important that the accommodation details are read in full.

Booking Ages
It is a condition of booking that we do not accept any bookings / reservations from a person aged under 18 years old. If it comes to our attention that a booking has been made by a person under 18 years old, then we are entitled to cancel any booking that is in breach of these terms. In this instance no refunds will be given.

Special Requests
We will always where possible pass on any requests to a Hotel / Property but NO GUARANTEE CAN BE GIVEN that a request will be honoured, therefore any reservation made, will not be conditional upon the confirmation of a special request.

Special Assistance
If you are disabled or incapacitated or of limited mobility or require special assistance for any reason, we require that you notify us at the time of making your booking. If these requirements change before your trip you must inform us. We will not subsequently be liable to you for any losses you may incur in the event that we or our suppliers are unable to accommodate your requirements.

Exclusion of Warranty
Luxury Faraway Holidays a part of Superior Travel and third party providers and distributors do not warrant the accuracy, completeness, merchantability or fitness for a particular purpose of any of the content or data found on this site.

Limitation of Liability
In no event shall Luxury Faraway Holidays a part of Superior Travel or third party providers or distributors be liable for any injury, loss, claim, damage, or any special, exemplary, punitive, incidental or consequential damages of any kind (including, but not limited to lost profits or lost savings), whether based in contract, tort or otherwise, which (i) arises out of or is in any way connected with any use of this site or content found herein, (ii) any failure or delay (including, but not limited to the use of or inability to use any component of this site for reservations or ticketing), or (iii) the performance or non performance by Luxury Faraway Holidays a part of Superior Travel or third party providers or distributors, even if such party has been advised of the possibility of such damages, or for any other party. Some states do not allow the exclusion of implied warranties or the limitation or exclusion of liability for incidental and consequential damages, so the above exclusion may not apply to you. If, notwithstanding the foregoing, Luxury Faraway Holidays a part of Superior Travel, or any third party provider or distributor should be found liable for any loss or damage which arises out of or is in any way connected with any of the above described functions or uses of this site or its content, Luxury Faraway Holidays a part of Superior Travel and third party provider's and distributor's liability shall in no event exceed, in the aggregate, the subscription fee and service charge for accessing this site with respect to which liability is found. In its sole discretion, in addition to any other rights or remedies available to Luxury Faraway Holidays a part of Superior Travel and without any liability whatsoever, Luxury Faraway Holidays a part of Superior Travel at any time and without notice may terminate or restrict your access to any component of this site. The foregoing terms and conditions shall apply to both contract and negligence claims.
In respect of international travel our liability to you will be limited or excluded in the same manner provided by the relevant international conventions mentioned below. This means that our liability to you shall be limited to the actual engaged liability (if any) of the operating carrier or transport company which undertakes the relevant travel services.
Superior Travel is recognised as an organiser for travel and holidays only and, as such, does not control or operate any airline, shipping company or rail company. When you travel your journey may be subject to certain international conventions such as, but not limited to, the Warsaw convention and Montreal convention (in respect of international carriage by air), the Athens convention (in respect of international carriage by sea) or COTIF (The convention Concerning International Carriage by Rail), as such conventions are amended or re-enacted from time to time (the "Conventions"). You agree that these Conventions will apply to you on that journey. Please click here to read these Conventions which are incorporated into these terms and conditions.
You agree that the operating carrier or transport company's own "Conditions of Carriage" will apply to you on that journey. When arranging this transportation for you, we rely on the terms and conditions and limits of liability contained within these international conventions and those "Conditions of Carriage". You acknowledge that all of the terms and conditions contained in those "Conditions of Carriage" form part of your contract with us as well as the transport company and that those "Conditions of Carriage" shall be deemed to be included by reference into your contract.

Age & Responsibility
You represent that you are of sufficient legal age to use this site and to create binding legal obligations for any liability you may incur as a result of the use of this site. You understand that you are financially responsible for all uses of this site by you and those using your login information.

Privacy
As a customer of Luxury Faraway Holidays a part of Superior Travel, you are in complete control of your travel planning needs. This includes controlling the use of information you provide Luxury Faraway Holidays a part of Superior Travel. When you reserve or purchase travel services through Luxury Faraway Holidays a part of Superior Travel, we provide information about you to the airline, car rental agency, hotel, Luxury Faraway Holidays a part of Superior Travel or other involved third party to ensure the successful fulfilment of your travel arrangements. We also use information you provide during registration or as part of the reservation process to customise the content of our site to meet your specific needs and to make product improvements to Luxury Faraway Holidays a part of Superior Travel. Luxury Faraway Holidays a part of Superior Travel will send you an e-mail message confirming each reservation you transact online. We do not sell individual customer names or other private profile information to third parties. As a member or contest entrant you will occasionally receive updates from us about fare sales in your area, special offers, new Luxury Faraway Holidays a part of Superior Travel services and noteworthy news. Carrying Proof of Purchase
You should ensure that you travel with your booking confirmations, e-tickets and any other travel documentation (including your passport) at all times. We will not be liable for any supplier not providing you with the booked product or service if you do not produce such documentation.

Assignment
You may not assign, convey, subcontract or delegate your rights, duties or obligations hereunder.

Modification
Luxury Faraway Holidays a part of Superior Travel may at any time modify these terms and conditions and your continued use of this site will be conditioned upon the terms and conditions in force at the time of your use.

Additional Terms
Additional terms and conditions may apply to reservations, purchases of goods and services and other uses of portions of this site, and you agree to abide by such other terms and conditions.

Severability
These terms and conditions shall be deemed severable. In the event that any provision is determined to be unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and such determination shall not affect the validity and enforceability of any other remaining provisions.

Headings
The headings used in these Terms and Conditions are included by convenience only and will not limit or otherwise affect these Terms and Conditions.

Entire Agreement
These terms and conditions contain the entire agreement between us relating to the subject matter hereof, and supersedes any prior understandings or agreements (whether oral or written) regarding the subject matter, and may not be amended or modified except in writing.
This is not a binding contract to either party until confirmation that tickets have been issued and credit card payment has been cleared.

Credit / Debit Card Charges
Credit card and debit card companies make a charge to process payments on their products. We will pass on this charge and this will be added to the final price of your travel arrangements. Typically this amounts to 2% of the total for credit cards from Mastercard and Visa.

Contact With You
The home address, telephone number and/or email address (if booking on our website) that you provide with your booking will be used for all future communication with you, including any changes and additional information on your flights and/or hotel bookings. It is therefore your responsibility to ensure that you check your email on a regular basis, and also notify us should your home address, email address or telephone number change.

If you Experience a Problem
In the unlikely event that you experience any problem with your booking our role as your Agent is to assist you and to liaise with the Travel Provider in an attempt to resolve the issues that you are experiencing. Local numbers of the Travel Providers will be listed on your documentation but our emergency number is also provided. The Travel Provider or Luxury Faraway Holidays a part of Superior Travel must be contacted before any decisions are made where additional costs are involved, for example, purchasing new flights or moving properties. If this is not adhered to any right to make a claim will be affected.

Travel Insurance
We strongly recommend that you do not travel without adequate Travel Insurance for your own protection and peace of mind, please be aware that some airlines may not allow you to travel without insurance. It is your responsibility to ensure that you purchase adequate travel insurance for your needs.

Cancelling your Travel Insurance
All insurance premiums purchased from Luxury Faraway Holidays a part of Superior Travel are payable in full at the point of sale and are sold incorporating a 14 day cooling off period after which time some policies may be non-refundable. The 14 day cooling off period only applies if you have not travelled or made any claim under the insurance policy. It is your responsibility to check the specific terms of the insurance policy at the time of purchase.

Disclaimer
The information advertised comes from Individual Travel Providers; As agents for Travel Providers we are constrained by the information they provide and on occassion errors may occur. Although every care is taken to ensure our prices and descriptions are correct, please be aware that as we use third party data, there may be occasions where the prices shown are incorrect.
